TERMS AND CONDITIONS OF SUPPLY

1. Introduction and Definitions

Any order and subsequent purchase of goods or services from us shall be governed by the following terms and conditions. Please read them carefully and note that they do not affect your statutory rights as a customer.

Throughout these conditions, "Spex4less" and "JP Opticians" are trading names for Fashion Specs Direct Limited. The terms "We", "Us" and "Our" refer to Fashion Specs Direct Limited (trading as Spex4less and JP Opticians), and "You" and "Yours" refer to the Customer.

We are completely dedicated to your satisfaction. We trade on the internet as www.spex4less.com, www.spex4less.co.uk, and www.jpopticians.com.

3. Customer Obligations & Eligibility

3.1. Safety and Well-being

This section is of fundamental importance to maintain your safety and well-being. By submitting your order to Spex4less, you confirm that you meet the following legal and safety requirements.

3.2. Legal Eligibility

You confirm that:

  • Age: You are aged 16 or over. We are legally unable to supply prescription eyewear to anyone under the age of 16.
  • Third-Party Orders: You are not purchasing glasses on behalf of anyone under the age of 16.
  • Sight Status: You are not registered blind or partially sighted.

3.3. Prescription Requirements

You confirm that:

  • Validity: You possess a written prescription for your spectacles that has been given to you by a suitably qualified person in the last 24 months (or 12 months if you are aged 70 or over).
  • Updates: If your prescription falls outside these timescales, or if your Optometrist has recommended an earlier sight test, you must obtain an up-to-date prescription before ordering.
  • Accuracy: The prescription details you provide to us match exactly those given on your written prescription.
  • Copies Only: If you are mailing your prescription to us, please send a copy only. Do not send the original document, as we cannot guarantee its return.

3.4. Reglaze Service Liability

If you are sending your own frames to us for reglazing (new lenses), please note the following:

  • Frame Risk: Spex4less does not accept responsibility for any damage or breakage to the customer's own frames during the glazing process. While we take every care, aged or brittle frames can sometimes fail during the fitting of new lenses.
  • Original Lenses: We cannot guarantee the return of your original lenses intact. The process of removing lenses from used frames carries a risk of breakage; if they break during removal, we will not be able to return them to you.
  • Posting Your Frames (UK): We provide a link to create a freepost label. You must obtain proof of postage from the Post Office; we cannot accept liability for parcels lost in transit without this proof.
  • Posting Your Frames (Overseas): Customers outside the UK are responsible for all postage costs to send glasses to us. We accept no responsibility for items lost in the post when sent to us.

Wraparound & High Curvature Frames: High curvature frames (often known as Base 8 or wraparound styles) require specialized lenses and glazing techniques.

  • Surcharges: These frames incur an additional glazing charge. If you do not select the appropriate "Wraparound" option when placing your order, we will contact you upon receipt of your frames to collect the required surcharge before work can commence.
  • Compatibility: Please note that these frames are optically compatible only with prescriptions up to -4.00 combined and +6.00 combined. Successful glazing is also strictly dependent on your Pupil Distance (PD). If your prescription is incompatible with the curvature of the frame you have sent, we will be unable to proceed and will contact you to arrange the return of your frames at your own cost.

4. Making a Purchase

4.1. Placing an Order

Making a purchase is simple. Browse our store, add items to your shopping cart, and click 'Checkout'. You will be asked for the details required to complete the order.

4.2. Stock Availability & Supplier Orders

We do not hold physical stock of all frames listed on our website; many items are ordered directly from our suppliers "as and when" you purchase them.

  • Stock Levels: We make every effort to keep our website up to date. However, supplier stock levels change daily. There may be instances where an item is listed as available but is found to be out of stock or discontinued when we place the order with our supplier.
  • Out of Stock Solutions: If this happens, we will contact you as soon as possible. You may choose to select alternative frames or cancel your order for a full refund.
  • Back Orders: You may also choose to place the item on back order. We will provide an estimated lead time based on supplier information. Please be aware that suppliers may change this lead time due to manufacturing or supply delays beyond our control.

4.3. Payment Methods & Currency

We accept most credit cards, PayPal, Klarna, and Link.

  • Billing Currency: Transactions are billed in the currency displayed on the specific regional website you are using (e.g., GBP for the UK site, USD for the US site, EUR for the EU site).
  • Currency Conversion: If you are shopping with a card denominated in a different currency than the website you are using (for example, using an Australian Dollar card on our US website), your card issuer will convert the transaction to your currency at their exchange rate.

4.4. Fair Use & Purchase Limits

As a small family-run business, we work hard to keep our prices as competitive as possible. To achieve this, we do not hold large volumes of stock on-site; instead, we order many frames directly from our suppliers specifically for you when you place an order.

  • Multiple Orders: We kindly ask that you do not order multiple pairs of glasses or sunglasses solely for "try-on" purposes. As these are special orders, handling multiple returns creates significant costs and waste that impacts our ability to offer low prices to all our customers.
  • Order Limits: We reserve the right to contact you or cancel orders containing multiple frames if we believe they are being purchased primarily for try-on purposes.

5. Payment and Pricing

5.1. VAT and Pricing

Prices stated are inclusive of any Value Added Tax (VAT) or Sales Tax that may be required to be remitted to tax authorities by Spex4less.

  • Currency: Prices will be shown and charged in the currency relevant to the regional website you are visiting (Sterling, USD, or Euros).
  • Basket Price: The price you pay is the retail price as appearing in your basket. We do not add tax to any amount shown in your basket.

5.2. Pricing Accuracy & Errors

We will use best endeavours to ensure the accuracy of the prices and price-related information stated on our website. However, we cannot guarantee that we will not make a mistake and misprice an item inadvertently.

  • Notification: If this is the case, we will notify you of the error.
  • Your Options: You will then have the choice to either accept the correct price or to cancel your Order.

5.3. International Taxes

In certain territories where we sell, we are required to report part of the sale price to the relevant tax jurisdiction and pay that amount in tax. We do not adjust our prices depending on the sales tax suffered, which varies from country to country.

  • Import VAT: Some countries may have rules imposed locally that will charge import VAT to the purchaser. Spex4less is unable to provide any refunds for such costs.

5.4. Reward Points

Reward points earned from your previous purchases can be used to obtain a discount at their current value.

  • Validity: Reward points are non-transferable and have no cash value. They expire 24 months from their issue date and cannot be exchanged for cash.
  • Rights: We reserve the right to withdraw our reward point scheme at any time without prior notice. We may also remove or adjust abnormally high reward point balances for any reason and without notification.

6. Credit Card Security

6.1. Encryption

When an order is placed on our website, credit card numbers are encrypted using 256-bit encryption. Online payments are secured with the latest SSL technology verified by GeoTrust Extended Validation SHA256 SSL CA.


7. Shipping and Delivery

7.1. Dispatch and Notification

Spex4less ensures goods are dispatched as soon as possible after your order is placed. We will confirm dispatch via email to give you an expectation of arrival.

7.2. Shipping Methods

  • UK Shipping: Royal Mail Tracked 24.
  • International Shipping: Royal Mail International Tracked and Signed For, International Signed For, or International Tracked.
  • Duties: All shipments outside the UK will be shipped DDP (Delivered Duty Paid) where possible.

7.3. Special Delivery Notes

Please note that selecting "Special Next Day Delivery" does not imply your glasses will be manufactured faster. It is a shipping option for added speed and tracking after dispatch.

7.4. Customer's Own Courier

We will gladly use a courier of your choice at your own expense, arrangement, and risk. However:

  • We do not refund our own shipping costs if this option is taken.
  • We do not accept responsibility for breakages or damages apparent on or after delivery.

8. Delivery Schedule

8.1. General Schedule

For full details, please refer to our online Delivery Schedule.

We aim to deliver most orders within 1 to 7 working days. However, please allow up to 15 working days to account for any quality failures or remakes during processing.

8.2. Estimated Dispatch Times

  • Standard Frames (Single Vision): 1–3 working days.
  • Standard Frames (Bifocal): 5–14 working days (allow 2-3 days longer for anti-reflective coatings).
  • Standard Frames (Varifocal): 5–10 working days after we receive your fitting frame and measurements.
  • Designer Frames: 1–14 working days (subject to supplier stock).
  • Sports/Safety Glasses: 5–10 working days.
  • Sunglasses: 2–10 working days (High wrap/mirrored lenses may take up to 15 days).

9. Safety Sports Glasses & Goggles

9.1. Product Warnings & Limitations

It is important to note that while safety and sportswear may enhance performance, the materials are designed to offer a degree of impact resistance but are not unbreakable.

Lenses used in sports eyewear are designed to protect and improve the safety of your eyes while participating in sports. Although polycarbonate and other sports lenses have a high degree of impact resistance, this does not mean that they are unbreakable or that you will not suffer any injury while wearing them.

9.2. Liability Exclusion

Nothing in these terms excludes or limits our liability for death or personal injury which arises from our negligence or any breach of our statutory duty.


10. Designer Sunglasses & Prescription Glazing

10.1. Standard Prescription Glazing

For most designer sunglasses, the original non-prescription manufacturer lenses (often bearing the designer logo) must be removed to fit your prescription lenses.

  • Original Lenses: If these original lenses are removed without damage, we will include them in the parcel along with your glazed prescription sunglasses.

10.2. Ray-Ban & Oakley Authentic Glazing

If you purchase Ray-Ban or Oakley sunglasses with their own "Authentic" prescription lenses, these are glazed externally by the manufacturers themselves.

  • Logos: These glasses will arrive with the official designer prescription lenses fitted, which will include the brand logo (e.g., the Ray-Ban or Oakley etching).
  • No Extra Lenses: As these are custom-manufactured directly by the brand, no additional non-prescription lenses will be included in the parcel.

10.3. Lens Swapping & Warranty

Warning: Please do not attempt to exchange the lenses yourself.

  • Void Warranty: Attempting to remove or re-insert lenses yourself puts significant stress on the frame. Any damage caused by self-fitting or lens swapping will void your warranty.
  • Exchange Service: To keep your warranty intact, if you wish to switch lenses (e.g. back to the originals where applicable), you must return the glasses and lenses to us. We will perform the exchange for you.
  • Costs: You are responsible for the postage cost to send the glasses to us. We will perform the swap free of charge, but we will charge a standard return shipping fee to send the glasses back to you.

10.4. Prescription Compatibility & Glazing Limitations

Frame Suitability: Please be aware that on occasion, certain frames may not be optically compatible with your specific prescription. While we use our best endeavours to highlight these restrictions on our website prior to purchase, it is not always possible to preempt every technical conflict, as each order is custom-made.

  • High Curvature (Base 8) Frames: In particular, "wraparound" style frames require highly curved base 8 lenses. These are generally only compatible with prescriptions up to -4.00 combined and +6.00 combined. Please note that successful glazing at these limits is also dependent on your specific Pupil Distance (PD).
  • Order Verification: If our technicians determine that your prescription cannot be safely or successfully fitted into your chosen frame, we will contact you immediately to discuss alternative options or process a full refund.

11. Frame Measurements

11.1. Accuracy

Frame dimensions are as accurate as possible but rely on manufacturer data. Batches may vary slightly in size; therefore, specified sizes are nominal and should be used as a guideline for fitting purposes.


12. Warranty, Exchanges and Returns

12.1. Our Guarantee

We guarantee your satisfaction with a full 100% money-back or exchange guarantee for any reason for prescription orders within 30 days of receipt. To prevent misuse, each customer is eligible for one free return or exchange every 6 months.

12.2. Fair Usage Policy & Fees (Custom-Made Items)

As prescription glasses are custom-made to your specific requirements, they are exempt from standard statutory return rights. However, under our goodwill guarantee, we allow returns subject to the following:

  • First Return: Free of charge.
  • Subsequent Returns: If you require additional exchanges or refunds after your one free exchange, we will deduct a contribution fee of 20% of the frame cost and 50% of the lens cost.

12.3. Frame Only / Non-glazed Orders (Stock Items)

For "Frame Only" orders, non-custom or non-prescription sunglasses (items supplied with dummy lenses or manufacturer lenses):

  • Statutory Period: You have a statutory right to cancel your order for a full refund within 14 days of receipt.
  • Condition: The goods must be returned in exactly the condition they were received.
  • Packaging: You must return the item in its original, undamaged branded packaging (box, case, cloth). If the packaging is torn, written on, or damaged, we reserve the right to deduct an amount from your refund to cover the diminished value of the goods (up to 100% of the value if the item is not resaleable).

12.4. How to Return

12.5. Condition of Returns

You must return the glasses or sunglasses unworn, in their original condition, within 30 days of receipt.

  • Accessories: Include all cases, cloths, and branded boxes.
  • Paperwork: Enclose a note with the reason for return, contact details, and order number.

12.6. Postage & Refunds

You are responsible for the cost of returning non-faulty goods.

  • International Returns: Mark clearly as "Returned Goods" to avoid import taxes.
  • Refund Processing: We will credit your account or exchange the goods. For "Frame Only" orders returned under statutory rights (within 14 days), we will refund the full item cost and standard outbound delivery charges.

12.7. Faulty Goods & Statutory Rights

Your rights to return goods are protected under the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015.

  • Faults: If there is a manufacturing fault, prescription error, or quality issue caused by Spex4less, we will remake or replace your glasses at no cost.
  • Return Postage: We cover all return shipping costs. We can provide a pre-paid return label for your convenience. Alternatively, if you arrange your own shipping, we will reimburse the cost (up to the value of our original standard delivery charge).

13. Home Trials

13.1. Home Trial Service

A home-trial service is available for selected frames and inserts at the company's discretion to help with purchasing decisions.

  • Deposit: We take an upfront payment for postage only.
  • Return Period: Frames or inserts must be returned to us within 14 days using the free post label supplied.
  • Proof of Postage: You must obtain proof of postage from the Post Office when returning the items. Without this proof, you are liable for the full retail cost of all parcel contents if the parcel is lost in transit.

13.2. Refunds (Free Trial)

Upon receipt of the frames or inserts in perfect, resaleable condition, we will refund the original postage payment in full, making the home trial service free of charge.

13.3. Failure to Return

Should you fail to return the home trial items within 14 days, or if items are returned damaged, you will be invoiced for the full retail price of all items received. We reserve the right to charge this amount to the payment method provided at the time of ordering.


14. Accessing Our Website

14.1. Service Availability

Access to our Website is permitted on a temporary basis. We reserve the right to withdraw or amend the service without notice. We will not be liable if the Website is unavailable at any time.


15. Trademarks, Copyright and Legal

15.1. Registered Trademarks

The terms Spex4less and SPEX4LESS are registered trademarks of Fashion Specs Direct Limited in accordance with the terms of the Trade Mark Act, 1994 of Great Britain and Northern Ireland. They, or any other registered or unregistered trademarks displayed on the Site, may not be used without the prior written consent of Spex4less.

15.2. Copyright and Intellectual Property

The Site's design, names, text, images, graphics, and logo are all owned by, or licensed to, Spex4less. They may not be reproduced for any commercial or public purpose without the express written consent of the Company.

15.3. Statutory Rights

These Terms and Conditions of Sales should be read in conjunction with the Spex4less Privacy Policy (https://www.spex4less.com/privacy-policy). Your statutory rights are not affected. Should you wish to obtain further information about your statutory rights, you may visit the Citizens Advice website: www.citizensadvice.org.uk.
